These are the terms and conditions on which our partner bakeries supply any of their products, the “Products”, listed on our website to you. Please read these terms and conditions carefully before ordering any Products from our site. By accessing our site and placing an order you agreed to be bound by these terms and conditions. “You” and “your” refers to the person using our Service to place an order. If you have any questions relating these terms and conditions, please contact us before you place an order. If you do not accept these terms and conditions in full, please do not use our Service.
Bakenet.ie is a website operated by Bakenet Limited (“we”, or “us”, or “Bakenet”), incorporated and registered in Ireland, whose registered office is at 15 Dakota Court, Dublin 7, Ireland. Our Company registration number is 578857. Bakenet is a business where orders are placed by consumers and send to bakeries (our “Partner Bakeries”).
Why are we here?
The purpose of our Service is to provide an easy way to find the cake you want, linking you to the right Partner Bakery and allowing you to order Products from them. We market Products on behalf of our Partner Bakeries and conclude orders on their behalf
Availability of our Service
We offer an ordering service from our Partner Bakeries. Some Partner Bakeries also offer a delivery service. Each Partner Bakery can decide when their services are available and if they accept your order or not. There is no guarantee that Product you order will be accepted by the Partner Bakery. A third party hosts our website. We cannot guarantee that our website is available at all times.
When you place an order through our Service, we will send an email to the Partner Bakery. When the Partner Bakery accepts your order, we will send you an email confirming your order (the “Confirmation Email”). The contract for the collection or delivery of the Product, is between you and the Partner Bakery, and will only be formed when you have been sent the Confirmation Email. Please ensure that you have given us a correct email address as this is how we will communicate with you about your order. Please also ensure that you provide an accurate address and telephone number to ensure that your Products arrive to the correct location in case of delivery. A Partner Bakery may ask you to show your identification upon collection of your Product. Please contact us when there is a problem with your order.
Products and allergen information
All products are subject to availability. The Partner Bakery may offer an alternative for any Product it cannot provide you with. Please contact the Partner Bakery prior to ordering if you have an allergy. We cannot guarantee that any of the Products sold by our Partner Bakeries are free of allergens. Please note that if you are pregnant or are a food allergy sufferer you may need to take caution when consuming any of the Products. For any questions regarding the allergen contents of specific Products please contact the Partner Bakery directly; the Partner Bakeries are exclusively responsible for all information regarding the contents of Products, including (but not limited to) food labelling information and information regarding allergens in the Products.
You can cancel your order if it has not been accepted by the Partner Bakery. After the Partner Bakery accepted your order, you can contact the Partner Bakery directly if you want to cancel the order. The Partner Bakery will decide if your order can be cancelled. You will not be charged for cancelled orders.
Price and Payments
The price of the Products and additional services like delivery are listed on our Service. Prices include VAT. Prices are liable to change at any time, but changes will not affect orders in respect of which you have been presented with the Confirmation Email, save in the case of an obvious pricing mistake, whereby we will notify you as soon as we can about the pricing issue. We may decide that you can cancel your order once we notify you of a mistake. Despite our best efforts, some of the Products listed on our Service may be incorrectly priced. The relevant Partner Bakery will normally verify prices as part of the order process. Payment for all Products can be made by credit or debit card through our Service. Once your order has been confirmed your credit or debit card will have been authorised and the amount marked for payment. Payment is made directly to us and is subsequently passed on to the Partner Bakery. We are authorised by our Partner Bakeries to accept payment on their behalf and payment of the price of any Products (including delivery) to us will discharge your obligations to pay such price to the Partner Bakery.
If you're not 100% satisfied with our service, contact us within 7 days and we'll assess refund requests on their merit, refunding up to the total amount of the product purchased.
This agreement and applicable law
If any provision of this agreement is judged to be illegal or unenforceable, the continuation in full force and effect of the remainder of the provisions shall not be prejudiced. These terms contain the whole agreement between the parties relating to its subject matter and supersede all prior agreements, arrangements and understandings between the parties relating to that subject matter. Bakenet may revise these terms on any time by amending this page. The Irish courts will have jurisdiction over any claim arising from, or related to, any use of our Services. These terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the law of Ireland.
